      • Personal information covered by certain sector-specific privacy laws, including the Fair Credit Reporting Act (FCRA), the Gramm-Leach-Bliley Act (GLBA) or California Financial Information Privacy Act (FIPA), and the Driver,s Privacy Protection Act of 1994.

How We Obtain Information

XOA collects personal information from the above categories directly from you, third parties, and automatically through our Services. Additionally, you may choose to voluntarily provide additional information to us. We may collect data about you from companies that help us verify your identity, do a credit check, prevent fraud, or assess risk.

    XOA collects personal information online that you provide to us, such as when you transact with us, create an account profile, submit a form, communicate with us, answer surveys, and when you sign up for a newsletter.

Action Tags and Other Technologies

Action Tags are commonly referred to as Web beacons or GIF tags. This type of technology is inserted in various places within our website to collect anonymous information about your visits to the XOA site and your interaction with our ads and content. XOA may use certain technologies to collect additional information related to the status and condition of your mobile devices. This information may be used to support the security of your transaction with XOA, determine industry trends, and for other research purposes.


How We Use Your Information

XOA may collect, transmit, and store information about you in connection with your use of XOA,s Services. Information Sharing

XOA may share information collected from or about you with others including within the group of XOA companies and with select third parties for a business purpose. When we disclose personal information for a business purpose the recipient must only use the information to perform its contracted service. We may also share personal information when we suspect fraud, to comply with applicable state and federal regulation, or for risk management.

  1. XOA Group of Companies. We may share information collected from or about you with our group of companies and corporate affiliates for the business purpose reasons outlined above.
  2. Service Providers. We may share information collected from or about you with companies that provide services to us and our business partners, including companies that assist with payment processing, analytics, shipping, fraud prevention, data processing and management, regulatory compliance and auditing, account management hosting, customer and technical support, marketing, advertising, measurement, and other services. For example, we share payment information with our third-party payment processor to assist with our billing efforts, email address with our marketing service providers to assist with our email campaigns, and home addresses with our shipping carrier.

How Long We Keep Your Information

XOA generally retains Personal Information if reasonably necessary to provide you the Services or to comply with applicable law. However, we can keep copies of information about you and any transactions or Services in which you may have participated for a period of time that is consistent with applicable law, applicable statute of limitations, or as we believe is reasonably necessary to comply with applicable law, regulation, legal process, or governmental request, to detect or prevent fraud, to collect fees owed, to resolve disputes, to address problems with our Services, to assist with investigations, to enforce our Terms and Conditions or other applicable agreements or policies, or to take any other actions consistent with applicable law.


How We Secure Information

The security of your information is important to us. XOA takes a variety of measures, including administrative, technical, and physical safeguards, to protect your information from loss, theft, and misuse, and unauthorized access, disclosure, alteration, and destruction. For example, we take steps to limit access to sensitive information from or about you to those XOA employees, agents, and contractors who have legitimate a business reason to access such information. We also use measures like encryption and hashing to help protect sensitive information when in transmission. Nevertheless, the internet is not a 100% secure environment, and we cannot guarantee absolute security of the transmission or storage of your information. We hold information about you both at our own premises and with the assistance of third-party service providers. Advertising and Tracking
Online Tracking and Advertising

XOA uses third-party advertising networks to distribute our advertisements on other websites and mobile applications where we have paid to advertise. These advertisements may use tracking technologies to capture certain information, such as IP address, usage information, or your responsiveness to our advertisements. This information is used to understand your browsing behavior and interests so we can identify your needs to provide tailored services and advertising.

XOA may contact you through email based on the products and services you have engaged with or information you provided. Marketing email communications will provide a link to unsubscribe from future related email communications or contact us through Contact Us and note "Privacy" as reason for contacting us. Do not send us a return email asking to be omitted from future email distributions as the sending email address might not be able to accept incoming email. You may also receive email communications that provide information and updates relating to a transaction with XOA which will not provide a way to unsubscribe.

XOA does not have a mechanism on its website that responds to a do-not-track signal from your browser. Behavioral Targeting

The third-party companies we use for online tracking have a network of advertising companies and may share with XOA anonymous information about your visits to xchangeofamerica.com and other websites and may use it to provide ads about goods and services of interest or relevant to you based on your browsing of our Services. From time to time, we may also share anonymous information with such third-party companies in an aggregate form, for purposes of analysis and improvement of our website. Geolocation Data

XOA does not access location data stored on your mobile device or computer without your permission. Some features, such as our branch finder tool, which locates the nearest XOA branch and shows the best route to get there, will not fully function unless you have enabled access to your location data.

Online advertising that relies on location tracking can be prevented by refusing to grant permission to use location data stored on your device. You can also set your device to block access to location data stored on your device. Refer to the user guide for your device.


Children,s Privacy

Our Services are general audience services not directed at children under the age of 13. We do not knowingly collect or solicit personal information from anyone under the age of 13 or knowingly allow such persons to register. If we learn that any collected information has been provided by a child under the age of 13, we will promptly delete that information.


Social Media and Website Communications

XOA maintains information on social media sites like Facebook, Twitter, and LinkedIn. When you post information on XOA social media pages it will be subject to the privacy and security conditions of the social media site. When you log into XOA owned social media properties, we collect information about your activities on those properties. The information we review includes whether you visited or commented on a blog or provided a rating.

Your California Privacy Rights

Under the California Consumer Privacy Act of 2018 (CCPA), California residents have certain rights around XOA,s collection, use, and sharing of their Personal Information. The CCPA is a right afforded to only residents of the State of California. Only you, or a person registered with the California Secretary of State who you authorize to act on your behalf, may make a verifiable consumer request related to your personal information. You may also make a verifiable consumer request on behalf of your minor child. You may only make a verifiable consumer request for access or data portability twice within a 12-month period. The verifiable consumer request must:

  • Provide sufficient information that allows us to reasonably verify you are the person about whom we collected personal information or an authorized representative.
  • Describe your request with sufficient detail that allows us to properly understand, evaluate, and respond to it.

However, we cannot respond to your request or provide you with personal information if we cannot verify your identity or authority to make the request and confirm that the personal information relates to you. Making a verifiable consumer request does not require you to create an account with us.

We will only use personal information provided in a verifiable consumer request to verify the requestor,s identity or authority to make the request.


Response Timing and Format

If you are a resident of California, we endeavor to respond to a verifiable consumer request for access to personal information within 45 days of receiving it. If we require more time (up to 90 days), we will inform you of the reason and extension period in writing.

Non-Discrimination

California,s Shine the Light Law
